1. Who we are
These terms govern the website design, development, hosting and care plan services ("Services") provided by Settled Media ("we", "us", "our") to clients ("you", "your") across Australia. By engaging Settled Media or using this website, you agree to these terms.
2. Our services
Settled Media builds and maintains websites for local service-based businesses, including the standard digital salesroom package: a mobile-first website, on-page local SEO setup, hosting, security, and ongoing care. Specific inclusions for your engagement will be confirmed in writing (email or invoice) before work begins.
3. Pricing and payment
Our standard package is a one-time setup fee plus a recurring monthly fee, as displayed on our pricing page or quoted directly to you. The one-time setup fee is payable before work begins. Monthly fees are billed in advance and cover hosting, security, unlimited text/photo edits, and ongoing SEO tune-ups as described in your package.
4. No lock-in contract
There is no fixed-term contract. You may cancel the ongoing monthly care plan at any time by providing 30 days' written notice to info@settledmedia.com.au. The one-time setup fee is non-refundable once work has commenced.
5. Turnaround times
We aim to deliver a live website within 5–7 business days of receiving all required content and approvals from you. Delays in providing content, feedback, or approvals may extend this timeframe.
6. Intellectual property
Once your setup fee is paid in full, you own the final website content and design created specifically for you. Settled Media retains ownership of any underlying tools, templates, or frameworks used to build it, and may reuse general design patterns and code structures for other clients.
7. Third-party services
Our websites may rely on third-party services (for example, form submission processing, hosting providers, or font libraries). We are not liable for outages or issues caused by these third-party providers, though we will assist in resolving them where reasonably possible.
8. Limitation of liability
To the maximum extent permitted by Australian law, Settled Media's liability for any claim arising from our services is limited to the amount you paid us in the 3 months preceding the claim. Nothing in these terms excludes any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Governing law
These terms are governed by the laws of Australia.
Privacy Policy
1. What we collect
When you submit an enquiry through our contact form, we collect the information you provide: your name, business name, phone number, industry, and any message details. We do not collect payment information through this website.
2. How we use it
We use the information you submit solely to respond to your enquiry, prepare a free website snapshot or quote, and — if you become a client — to deliver our services to you. We do not sell or rent your personal information to third parties.
3. How enquiries are processed
Our contact form submissions are processed by Web3Forms, a third-party form-handling service, which emails your enquiry directly to us. Web3Forms does not use your data for any purpose beyond delivering the submission. See Web3Forms' privacy policy for details on their handling of data in transit.
4. Cookies and fonts
This website loads fonts from Google Fonts, which may involve your browser connecting to Google's servers. We do not use tracking or advertising cookies on this site.
5. Data storage and security
Enquiry information is stored in our business email inbox and, if you become a client, in our client records. We take reasonable steps to keep this information secure and only retain it for as long as necessary to provide our services or as required by law.
6. Your rights
You can request access to, correction of, or deletion of the personal information we hold about you at any time by emailing info@settledmedia.com.au.
